All our prices are inclusive of tax at the rates in force from time to time. Except in the case of manifest error, the prices payable for the services that you order are as set out on this website at the time at which you place your order. You confirm that the account/credit/debit card which is being used is yours. All account, credit/debit card holders are subject to validation checks and authorisation by the bank/card issuer.

All fees are non-refundable and non-creditable. All price references are in us dollars. The prices and terms of sale for subscriptions to any service and other content transactions will be those in effect (and presented to you either through the purchase process and/or incorporated by reference via presenting you with a link to the purchase terms during that process) on the date on which you submitted sufficient information to complete your order (e.g. Valid credit card information).

Total sports tv reserves the right to change prices for its services at any time, and total sports tv is not responsible to you for any sudden price changes, including without limitation requiring payment for content that was previously free or reducing or eliminating charges for content that previously required payment (whether or not you had subscribed to such content). Notwithstanding the foregoing, if total sports tv raises the price of, or otherwise changes the material terms to, a subscription package, total sports tv will give current affected subscribers advance notice by using the contact information provided as part of the registration data, and such subscribers may cancel the relevant subscription(s) within thirty (30) days of the notification to avoid being bound by the new pricing or terms. Automatically renewing subscriptions will be automatically charged to you at the then-current price at the time of renewal using the credit card or other payment methods used by you.

If you have insufficient funds available or automatic payment is otherwise unavailable, your subscriptions may not automatically renew. You are responsible for keeping total sports tv informed of your current email address, for checking your spam/bulk mail filters for important notices about upcoming changes to your service, for contacting us via email if you do not accept those changes, and for the loss or non-delivery of such notices. Total sports tv shall not be liable in any way with respect to the timing of any charges to your credit card.

Total sports tv reserves the right to refuse all credit/debit card/paypal payments in its reasonable discretion. 

Total sports tv may terminate this agreement with immediate effect and by written notice at any time if you commit a material breach of this agreement.

In addition, total sports tv may terminate this agreement on one calendar month's notice given in writing to you. If total sports tv terminates the agreement other than as a result of your breach or technical non-compliance, you will receive a refund of the amount you pre-paid for the services less an amount proportionate to the number of days for which you have had access to the services.

Total sports tv expressly reserves the right to, at its option, immediately modify, suspend or terminate your account and refuse current or future use of any service by you if:

(a) your credit card or alternative payment method is invalid for any reason,

(b) you charge back to your credit card or alternative payment method the fees due to total sports tv,

(c) total sports tv, at its sole discretion, believes that you have engaged in manipulation of any service,

(d) total sports tv, at its sole discretion, believes you have violated or tried to violate the rights of others,

(e) total sports tv, at its sole discretion, believes you have failed to provide or maintain valid, accurate, current and complete registration data or other information,

(f) total sports tv, at its sole discretion, believes you have disclosed your service password or other information to any third party, or used your account to enable access to the service for anyone other than yourself,

(g) total sports tv, at its sole discretion, believes you have acted inconsistently with the spirit or letter of the terms, or

(h) total sports tv, at its sole discretion, believes your safety, or the safety of other users of the service or the general public, is in jeopardy.

Total sports tv may exercise its remedies immediately upon occurrence of the events listed above, without prior notice to you and without refund or compensation to you. Total sports tv shall have the right to terminate your account and refuse current or future use of any service by you for any reason other than those set forth above or no reason, provided total sports tv refunds to you (a) for the subscription period of each affected service that has not yet commenced, the service subscription fee you have pre-paid to total sports tv and (b) for subscription periods of each affected service and has already commenced, the prorated amount of the applicable pre-paid subscription fee attributable to the remainder of the subscription period. Except as expressly set forth above, total sports tv's actions in exercising its rights hereunder shall not relieve you from your obligations under the terms.

You understand and agree that the services may include content such as advertisements, service announcements, programme information and administrative messages. Such content is considered part of the service. Unless explicitly stated otherwise, any new features that augment or enhance the current service(s) or are delivered through other distribution means shall be subject to these terms. You understand and agree that the services are provided "as is" and that total sports tv assumes no responsibility for the timeliness, deletion, nondelivery or failure to store any user correspondence, information or personalization settings.

You are solely responsible for obtaining access to the services and that access may involve third party fees (such as internet service provider or air time charges). You are solely responsible for those fees. In addition, you must provide and are solely responsible for all equipment necessary for you to access the services. You agree not to access the services by any means other than through the interface that is provided by total sports tv for use in accessing the services. You also acknowledge that your right to access the services is limited to the number of hours (or other applicable parameters) specified in the subscription package you purchase from total sports tv. Due to rights restrictions; certain programming may not be available in certain territories. You agree that your subscription may not entitle you to receive all the programming on one or more of the services.

Total sports tv will use its reasonable endeavors to ensure that the services are made available to you at all times. 

The service is provided "as is" and on an "as available" basis, without warranties, conditions, or representations of any kind, either express or implied, and we (and any third party providing materials) hereby disclaim any express or implied warranties, conditions, or representations of title, merchantability, fitness for a particular purpose, non-infringement of third party rights, completeness, accuracy or timeliness of the information or freedom from computer viruses, worms, trojans or any other similar code;

In particular, the image and sound quality of the services may vary, whether due to congestion on the internet or telephone lines or otherwise. The website may not be uninterrupted, timely, secure or error-free.

From time to time we will need to close the website to carry out upgrades or maintenance. We will try to keep this to a minimum. You hereby indemnify, defend and hold harmless total sports tv, and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "indemnified parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees and expenses, suffered or incurred by the indemnified parties in connection with any claim arising out of any breach by you or any user of your account of this agreement or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. Total sports tv reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

These conditions shall be exclusively governed by and construed in accordance with the laws of singapore and you irrevocably submit to the exclusive jurisdiction of the courts of singapore.

Unless agreed otherwise in writing, the maximum liability of total sports tv and total sports asia ltd to you arising by reason of or in connection with the supply of the services to you shall be limited to the amount paid by you in respect of the services in question ("payment amount"). Neither total sports asia ltd nor total sports tv shall in any event be liable to you for:

(i) any direct loss in excess of the subscription amount; or

(ii) any indirect or consequential loss or other costs; or

(iii) any corruption to data or any indirect or consequential loss what so ever even if it has been advised of the possibility of such loss or should reasonably know of such loss. Nothing in these conditions shall exclude or limit the liability of total sports asia ltd and total sports tv for death or personal injury due to its negligence or for its fraud. This does not affect your statutory rights as a consumer.

Total sports tv shall not have any liability to you for any delay or failure to deliver the services to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of total sports tv, but not limited to, the failure of electronic or mechanical equipment or communication lines, third party action (including denial of service attack and overuse or misuse of the services), telephone or other inter connect problems, computer viruses, unauthorised access, theft, operator errors, fire, severe weather conditions, including floods, acts of god, acts or regulations of any regulatory, governmental or supranational authority, war, riot, strike, lock-out, industrial disputes and the cancellation or postponement, withdrawal of feed by broadcaster for any reason whatsoever.

If this means that you fail to receive a substantial element of the services total sports tv will refund such proportion of the sum pre-paid by you in respect of the services as it decides, acting reasonably, is fair in the circumstances.

No waiver by total sports tv shall be construed as a waiver of any rights or remedies, or any subsequent breach of any provision of these conditions.
